Personal injury accidents are a common occurrence. At first blush, most people think that resolving their claim should be therefore a matter of common sense! Unfortunately, most people how have not previously gone through the claim process. They may have several misconceptions about the claim process. As a result, most people who try to handle their claim without competent representation end up with a very unfair and unsatisfactory result. Here are some of the more common misconceptions that hurt most claimants:
- The insurance company is concerned about my welfare and will treat me fairly.
- The insurance adjuster is an expert and knows what is fair and appropriate.
- Attorneys will take a percentage of my recovery and not get me a recovery more than what I can do on my own.
- My injuries are not that bad and it is wrong for me ask for more than my medical bills.
- If I make a claim (or claim for more than my medical bills) my insurance rates will go up.
- There are too many phony insurance claims and I don't want to be thought of as being just another "one of those".
Certainly, the insurance industry would like you to believe in each and every one of these "misconceptions". Unfortunately, injuries that occur in accidents are often more serious than they first appear and have a greater impact on the victim's life, long after the accident. Even though fault and who is responsible for your injuries in many instances is uncontested, the question as to what constitutes "fair compensation" for your injuries can be very complicated. In determining the compensation for which you are entitled, you must know your rights. The best source of that information is from a competent attorney who has your interests (and not the insurance company's interests) in mind. Remember that the insurance adjuster with whom you are talking is an employee of the insurance company and it is the insurance company's interests that come first and foremost to that adjuster. Retaining an attorney to help you understand what you are entitled to may be the best investment you can make in assuring that you will recover what is fair!
